Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioners are apprehending their arrest in
Patna High Court CR. MISC. No.20625 of 2021(2) dt.20-12-2021 2/3 a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 222, 332, 269, 270, 290 of the Indian Penal Code, Section 3 of the Prevention of Damage to Public Property Act and Section 3 of the Epidemic Disease Act.
It is alleged against all the accused persons including the petitioners that they have blocked the road in protest of arrest of the accused persons in connection with Nathnagara P.S. Case No. 439 of 2020 and when the informant along with other police personnel went to clear the road, they have been assaulted by lathi, danda, iron rod. The accused persons obstructed the informant in discharge of his official duties.
It is submitted by learned counsel for the petitioners that the accusation against the petitioners is general and omnibus. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.
