JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Heard learned counsels for the petitioners and the State. The petitioners being the son-in-law and son of the informant are apprehending arrest in a case registered for the offences punishable under Sections 120B, 420, 406, 409, 467 and 468 of the Indian Penal Code.
It is alleged that the informant being an illiterate lady deposited Rs. 11,09,000/- in her account which was fraudulently withdrawn by the petitioners.
It is submitted by learned counsel for the petitioners that withdrawal was made on 23.09.2012 against which a complaint was filed on 22.01.2014 which came to be registered as a police case on 16.07.2014 and the bank has not come forward to say that the withdrawal has been made with the forged signature of the informant.
