JUSTICE AMARESH KUMAR LAL ORAL ORDER 03-02-2015 Heard the learned counsel for the petitioners and the learned counsel for the State.
The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 323, 326, 341, 307/504 and 302 of the Indian Penal Code. The allegation against the petitioners is that at the instance of the co-accused Suresh Yadav, they had thrown bricks on the deceased.
It is submitted that the deceased died due to fire shot made by Suresh Yadav and the injury caused to Nitish Kumar by the other accused including the petitioners is simple in nature. The petitioners have no criminal antecedent.
Patna High Court Cr.Misc. No.4516 of 2015 (2) dt.03-02-2015 2/2 Considering the facts and circumstances of the case, let the petitioners above-named be released on bail in the event of arrest or surrender within a period of four weeks on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in Rafiganj P.S. Case No. 113 of 2014 subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
