JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2020 The petitioner seeks bail in connection with Jogbani P.S. Case No. 349 of 2019, arising out of Special Case No. 1628 of 2019 instituted for the offences under Sections 30(a), 38(i) of the Bihar Prohibition & Excise Act, 2016.

It appears from the record that 69 litres of liquor was recovered from two motorcycles from where two persons are stated to have been arrested including the petitioner.

Mr. Mukesh Kumar Rana, learned advocate for the petitioner has informed this Court that the other

Patna High Court CR. MISC. No.11162 of 2020(2) dt.28-02-2020 2/2 accused person has been granted bail by a Coordinate Bench of this Court today.

The petitioner is in custody since 30.11.2019. Regard being had to the nature of accusation against the petitioner, period of custody and the fact that petitioner does not have any criminal antecedent, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Jogbani P.S. Case No. 349 of 2019, arising out of Special Case No. 1628 of 2019.
