JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 354/34 of the Indian Penal Code and Section 3 (iii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Allegation against the petitioner is that he along with other two accused persons attempted to outrage modesty of the informant. They also threatened informant at night. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has been falsely implicated in the present case. General and omnibus allegation is made against the petitioner.
On behalf of the State, it is submitted that petitioner is named in the F.I.R. and repeatedly participated in the alleged crime.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.
Any how, if petitioner surrenders in the court below, i.e.,
Patna High Court Cr.Misc. No.5441 of 2016 (2) dt.18-03-2016 2/2 Sri Anil Sinha, Judicial Magistrate, Ist Class, Patna, in connection with Parsa Bazar P. S. Case no. 147 of 2015 within a period of six weeks from the date of receipt of a copy of this order and prays for regular bail, same shall be considered and disposed of on its own merit without being prejudiced by this order.
