The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 467, 468, 471 and other sections of the Indian Penal Code and sections 66 and 66(c) of the I.T.Act.

As per the prosecution case, seeing the police personnel 6-8 boys who were standing in a suspicion condition made an attempt to escape. On chase, four of them including the petitioner herein was caught. It is stated that 5 ATM cards, Rs. 20,000/- in cash and a mobile phone was recovered from his possession. It is further stated that the accused persons were changing the password and were into withdrawing amounts from different accounts.

No incriminating article has been recovered from his possession. He was arrested under a misunderstanding. He is in custody since 17.10.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation levelled in the FIR together with the petitioner having remained in custody for more than 11 months, the petitioner is directed to be enlarged on bail in connection with Majhaulia P.S. Case no. 708 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran.
