2. The petitioner seeks regular bail in connection with Kurtha (Manikpur O.P.) P.S. Case No. 110/2023 lodged on 25.03.2023 under Sections 366A, 376 of the Indian Penal Code, Section 4 of the Protection of Children from Sexual Offences Act, 2012 and Sections 9/10 of the Prohibition of Child Marriage Act.
3. As per the prosecution case, the FIR has been lodged against five named accused persons, including the present petitioner alleging therein that the petitioner has eloped the daughter of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Annexure2 has been annexed by which it transpires that the alleged victim
Patna High Court CR. MISC. No.20862 of 2024(2) dt.02-04-2024 2/2 is majour. Counsel further submits that the alleged victim has been recovered and got her statement recorded under Section 164 of the Cr. P.C. wherein she has disclosed that she went Punjab with her own sweet will alone and from there, she visited the house of the petitioner where he was working. Counsel further submits that both the parties have entered into a compromise and has filed a petition to that effect which is annexed as Annexure-4 to the petition. The petitioner is in custody since 05.04.2023 having no criminal antecedent.
5. Learned counsel for the State opposes the prayer for bail.
6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIcum-Special Judge, POCSO, Jehanabad, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
