JUSTICE BIRENDRA KUMAR ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 325/341/307/302 and other minor sections of the Indian Penal Code.

At the time of occurrence petitioner was carrying a pistol, however, no overt act has been alleged against the petitioner; rather injury caused by Md. Ali with Khanti at the head of the brother of the informant caused subsequent death. The occurrence took place due to dispute regarding measurement of land.

It appears that Md. Sadique @ Md. Sadique Hussain and Md. Hassan @ Umar Hassan @ Md. Hassan Imam @ Hussin Imam @ Hasan Imam have already been allowed bail by a

Patna High Court Cr.Misc. No.7716 of 2017 (2) dt.21-02-2017 2/2 coordinate Bench of this Court in Cr. Misc. Nos.46914 and 48750 of 2016 on 30.01.2017 and 03.02.2017 respectively. Learned counsel for the informant opposes the prayer for bail.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/Successor Court, in connection with Begusarai Muffasil (Lakho) P.S. Case No. 305 of 2016.
