The petitioner apprehends his arrest in connection with Chanpatia P.S. Case no. 409 of 2018, registered under Section 30(a) of the Bihar Prohibition and Excise Act. The accusation is that on receiving secret information about carrying of liquor loading on Tata Indigo, the informant along with other Police personnel reached at Chhotka Chowk and found one Tata Indigo vehicle in parking condition. In presence of the witnesses, the said Tata Indigo was searched then 08 cartons, each containing 43 bottles of 375 ML and 03 cartons, each containing 48 bottles of 180 ML recovered.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.10410 of 2019(4) dt.08-07-2019 2/2 Prabhat Kumar, owner of Tata Indigo vehicle was apprehended after eight days of the occurrence, who disclosed the name of the petitioner saying that this petitioner used to do business of liquor earlier with him. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, West Champaran at Bettiah in connection with Chanpatia P.S. Case No. 409 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
