JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsel for the petitioner and the State. The petitioner being the father-in-law of the victim lady is apprehending his arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code. The accusation against the petitioner is of killing the victim lady after marriage by setting her on fire. It is submitted by the learned counsel for the petitioner that the F.I.R. does not suggest any demand of dowry and thus no case under Section 304-B of the Indian Penal Code has been made out.
Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner. However, since the anticipatory bail application of the petitioner was rejected by the learned Sessions
Patna High Court Cr.Misc. No.5261 of 2015 (2) dt.09-02-2015 2/2 Judge vide order dated 2.11.2012, the court below shall consider the prayer for regular bail of the petitioner without being prejudiced by the order of this Court.
