The petitioner apprehends his arrest in Chanpatia P.S. case No. 409 of 2018 registered under Section 30(a) of Bihar Prohibition & Excise Act.

The informant, S.I. of police, got information that Prabhat Kumar was carrying Indian Made Foreign Liquor on Indica car and on such the car was intercepted near Chhotaka Chowk from which 11 cartoons of different brands of IMFL were recovered.

The learned counsel for the petitioner submits that later on Prabhat Kumar was apprehended and he disclosed that petitioner was also involved in illegal trade of illicit liquor. It is submitted that nothing has been recovered from the possession

Patna High Court Cr.Misc. No.10176 of 2019(2) dt.20-02-2019 2/2 of petitioner. It is further submitted that nothing has been recovered from the house or any place said to be in conscious possession of the petitioner.

Taking into consideration the facts that petitioner is not named in the FIR and the informant got information that Prabhat Kumar was carrying illicit liquor and after being arrested he disclosed the name of petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, West Champaran, Bettiah in connection with Chanpatia P.S. case No. 409 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
