The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 2452 of 2017, Trial No. 2150 of 2018 in which cognizance has been taken under Sections 420, 406 of the Indian Penal Code and Section 138 of N.I. Act.

The cheques issued by the petitioner in favour of the opposite party no. 2 has not been respected. Learned counsel for the petitioner submits that the matter was referred to the Patna High Court Mediation Centre but till date the mediation process has not concluded. Perhaps this is for the reason of

Patna High Court CR. MISC. No.13784 of 2020(7) dt.07-12-2021 2/2 Pandemic closure.

However, since the petitioner is ready to negotiate with opposite party no. 2 for settlement of dispute, this Court directs that in the event of the petitioner surrendering before the court below, he shall be released on provisional bail. Simultaneously, notice shall be issued to opposite party no. 2. On appearance of the parties, ample opportunity shall be provided by the court to the parties to sit across the table and negotiate their differences. In case the dispute is settled, the provisional bail granted to the petitioner shall be confirmed. In the event of the dispute not being settled, the petitioner would have the liberty to surrender before the court below and seek bail.
