The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a), 31, 35, 38, 41 and 56(d) of the Bihar Prohibition & Excise Act, 2016.

Considering the fact that the petitioner has got criminal antecedent of identical nature, I am not inclined to enlarge him on anticipatory bail in connection with Bettiah (Muffasil) Police Station Case No. 586 of 2018 pending in the court of learned Special Judge, Excise Act, West Champaran at Bettiah.

Hence, prayer for anticipatory bail is refused. However, in the event of surrender and on prayer for regular bail, the same shall be considered on its own merit without being prejudiced by this order.
