The petitioner is apprehending his arrest in Ashok Paper Mill (A.P.M.) P.S. Case No. 35/2014 registered under Section 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

The informant herself alleged that she fell in love with the petitioner and thereafter the petitioner took her to Delhi and solemnized marriage with her.

Learned counsel for the petitioner submits that the informant is a legally wedded wife of the maternal-uncle of the petitioner. The petitioner never solemnized marriage with the informant. The petitioner refused to accompany the informant as would appear from the order of the learned Sessions Judge.

Patna High Court Cr.Misc. No.4923 of 2015 (2) dt.04-02-2015 2/2 Learned A.P.P., however, opposed the prayer for anticipatory bail.

On the facts, it appears that the petitioner is the nephew of the informant and the informant alleged that she fell in love with the petitioner although the informant was also married with the maternal-uncle of the petitioner.

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Ashok Paper Mill (A.P.M.) P.S. Case No. 35/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
