JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 337, 353, 427, 324, 307 of the Indian Penal Code. The prosecution case is that the informant being police officer along other police personnel went to pacify the scuffle between the two groups when stones were pelted causing damage to the vehicles and injuries to the police personnel.
It is submitted by learned counsel for the petitioners that accusation is omnibus and general. The petitioners' side lodged Khaira(Nagra) P.S. Case No. 143 of 2015 against Sri Bhagwan Rai and others, whereas other side also lodged Khaira(Nagra) P.S. Case No. 145 of 2015 against the petitioners and others. The petitioners have also received
Patna High Court Cr.Misc. No.7285 of 2016 (2) dt.18-02-2016 2/2 injuries in the incidence.
Considering the accusation against the mob, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saran at Chapra in connection with Khaira(Nagra) P.S.
