The petitioners, Karu Kumar Singh @ Karu Singh and Raushan Singh, apprehend their arrest in Mohiuddin Nagar P.S. Case No. 121/2014 registered under Section 307 and other sections of the Indian Penal Code.
Pancha Devi, the informant, named the petitioners along with other accused persons and alleged that they all went into the orchard of the informant for plucking mangoes and, on protest by Sant Kumar Singh, they brutally assaulted Sant Kumar Singh. Sant Kumar Singh was lying unconscious. Learned counsel for the petitioners submits that the allegation is false and concocted. The doctor examined the injured in the evening and gave report that the injuries are caused within
Patna High Court Cr.Misc. No.4927 of 2015 (2) dt.04-02-2015 2/2 four hours. The occurrence is said to have taken place at 12:00 in the night. The report of the doctor belies the prosecution story. The injuries are simple in nature.
On perusal of the record, it appears that there is a very specific allegation against the petitioners. The petitioners along with others brutally assaulted Sant Kumar Singh. The injured got many injuries. He was referred to P.M.C.H. for better treatment.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Mohiuddin Nagar P.S. Case No. 121 of 2014. Accordingly the same is rejected. (Prabhat Kumar Jha, J) Dilip/- U T
