The petitioner is apprehending his arrest in connection with Complaint Case No.280C of 2017 dated 14.2.2017 , registered for offences punishable under Sections 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act. As per the complaint petition, there is allegation of demand of one motorcycle by the accused persons including the petitioner and for that she was tortured and ousted from the house.

Submission of the learned counsel for the petitioner is that he is still ready to keep her and he has a son also and the allegation of demand is false and concocted and no specific allegation has been attributed against him.

Heard learned A.P.P. also.

No.10786 of 2019(4) dt.10-05-2019 2/2 In this cae notice was issued to the O.P.no.2 and in spite of valid service of notice, O.P.no.2 is not present nor any person appeared on behalf of the O.P.no.2 earlier also on 26.4.2019 nobody appeared on behalf of the O.P.no.2, as such the case was posted for admission today but no body appears on behalf of O.P.No.2 today also.

Having heard both sides, in such view of the matter, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, West Champaran at Bettiah in connection with Complaint Casse No.280C of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
