ANJANA MISHRA ORAL ORDER 12-05-2016 Heard learned counsel for the petitioner and the learned counsel for the informant as well as the learned counsel appearing on behalf of the State.

The petitioner, being the husband of the deceased, is apprehending his arrest in connection with Turkauliya P.S. Case No.573 of 2015 for allegedly having committed the offence under Section 304B of the Indian Penal Code, pending in the court of the learned Chief Judicial Magistrate, East Champaran at Motihari.

Case diary in the present case was called for, which has since been received.

It appears from the materials, which have surfaced in

Patna High Court Cr.Misc. No.5501 of 2016 (3) dt.12-05-2016 2/2 the case diary, that actually charge sheet has been submitted under Sections 302 and 201/120B of the Indian Penal Code against the accused persons, including the present petitioner. Investigation as against the petitioner is still going on. Case diary also indicates the complicity of the petitioner as just prior to the death, there was a demand for dowry. The body was also cremated surreptitiously without knowledge to her parents. In view of the aforementioned facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.
