The petitioner apprehends his arrest in Ara Town PS Case No. 684 of 2021 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 1.875 litres of foreign liquor has been recovered from Platina motorcycle of which this petitioner is registered owner. It is submitted that no recovery has been made from conscious possession of this petitioner. One Ritesh Kumar took the motorcycle of petitioner and without his knowledge and consent used the said motorcycle in transportation of liquor. Petitioner claim clean antecedents.

Learned APP however vehemently opposed the prayer for bail .

Considering the fact that petitioner is registered owner

Patna High Court CR. MISC. No.11944 of 2023(2) dt.28-04-2023 2/2 of the motorcycle in question, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
