JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with Brahampura P. S. Case No.70 of 2019 registered for the offences punishable under Section 414/ 34 of the I.P.C. and Section 30(a), 41(I) of the Bihar Prohibition and Excise Act, 2018.

26.250 litres of English liquor is said to have been recovered from a motorcycle.

Learned counsel for the petitioner submits that the alleged recovery is not from the conscious possession of the petitioner nor the motorcycle belonged to the petitioner and he has been implicated merely on basis of suspicion. Petitioner is in custody since 17.12.2020.

Patna High Court CR. MISC. No.21282 of 2021(2) dt.15-11-2021 2/2 submits that against the petitioner, there are four cases as mentioned in Para-3 of the petition, to which learned counsel for the petitioner submits that in all the Excise cases, the petitioner is being implicated by the police.

Considering the fact that the petitioner is in custody since 17.12.2020 and charge-sheet has been submitted, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Brahmpura P. S. Case No.70 of 2019.
