Petitioner seeks bail in Bikram P.S. Case No.301 of 2019 registered under Sections 302 and 201 of the IPC. The informant alleged that his father became traceless. During course of search, the informant came to know that Shyam Babu Yadav, who used to come to his house, with the help of the mother of the informant, namely, Bijanti Devi (petitioner) killed the father of the informant by pushing him in the canal.
Learned counsel for the petitioner submits that there is no eye witness of the occurrence. Save and except suspicion, there is no material against the petitioner. Shyam Babu Yadav has already been granted bail by a coordinate bench of this court vide order passed in Cr.Misc.No.85652 of 2019. The case of the
Patna High Court CR. MISC. No.9715 of 2020(5) dt.19-06-2020 2/2 petitioner stands on the same footing. The petitioner is the wife of the deceased and nobody has seen the petitioner leaving the house along with the deceased. The petitioner was found inside her house.
Having considered the facts aforesaid and the fact that similarly situated co-accused, namely, Shyam Babu Yadav has already been granted bail, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M.,VI, Danapur, Patna in connection with Bikram P.S.
