The petitioner seeks regular bail in connection with Lalganj P.S. Case No. 318 of 2020 dated 14.10.2020 instituted for the offences under Sections 30(a)(d)(e)(f), 32 (ii) and 41(i) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant had alleged that he received information that Ajay Rai, Anil Rai, Bipul Kumar, Dharmendra Sahni and Bipin Rai are involved in trade of illegal liquor. It is alleged that on raid at village Salempur in presence of the said information, the house of Bipul Kumar was raided and a person was seen fleeing away through the field using backyard of the

On chase he was caught and disclosed his name as Bipul Kumar and revealed that illegal liquor has been kept inside his house and upon search of the same in presence of witnesses, 100 litres of country-made liquor was recovered from his house. Further, upon inquiry it transpired that all the family members are involved in trade of illegal liquor and the police proceeded to the place indicated by Bipul Kumar where manufacturing of illegal liquor was being conducted and on reaching the said place, about 1500 litres of raw java used for manufacturing illegal liquor was also recovered.

Learned counsel for the petitioner submits that said Bipul Kumar has been granted bail by this Court vide order dated 13.07.2021 in Cr. Misc. No. 20268 of 2021. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 17.12.2020, co-accused has been granted bail and the charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in
