The petitioners are apprehending their arrest in connection with Bhagwanpur P.S.Case no.177 of 2018 , registered for offences punishable under Sections 341, 323, 504, 498(a)/34 of the Indian Penal Code.
Allegation against the petitioners and other accused persons is of assaulting the daughter of the informant after marriage, thereafter she is traceless and in spite of search, she was not found and they apprehend that any untoward has happened with her.
Submission of the learned counsel for the petitioners is that there is general and omnibus allegation against the
Patna High Court CR. MISC. No.11472 of 2019(3) dt.29-04-2019 2/3 petitioner no.1, who is 'Gotani', petitioner no.2 is husband of petitioner no.1, petitioner no.3 is the mother-in-law and petitioner no.4 is the son of the petitioner no.1 and they are living separately with the victim.
Heard learned A.P.P. ,who has opposed the prayer for bail on the ground that all the witnesses have supported the prosecution case , however, he could not controvert that no specific allegation has been mentioned against any of the petitioners.
Having heard both sides and in view of the fact that since the petitioner no.1 and 3 are female, as such let petitioner nos.1 Mina Devi and 3. Savitri Devi in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Bhagwanpur P.S.Case no.177 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition hat they will co-operate in the investigation. So far petitioner no. 2. Manikatn Jha and 4.Gautam Kuamr Jha @ Gautam Kuamr are concerned, they are directed
