Earlier, the bail petition of petitioner was rejected, vide order dated 26.09.2019 passed in Cr.Misc. No. 39838 of 2019 with an observation that if the trial would not be concluded within specified time, due to laches on the part of the prosecution, necessary order would be passed in the matter. On last occasion, vide order dated 24.11.2021, fresh status report with regard to stage of the trial was called for, which has been received and kept at flag 'D'. From perusal of the same, it appears that four witness have already been examined and trial is likely to be concluded within six months. It is submitted on behalf of petitioner that trial is not progressing smoothly and petitioner is languishing in jail since

However, learned counsel for D.R.I. opposed the bail petition.

Considering the aforesaid facts and circumstances as well as the fact that in this case, huge quantity of Ganja has been recovered and stage of the trial, the bail petition of petitioner is rejected. However, since the petitioner is in custody since 01.09.2017, the learned trial court is directed to conclude the trial as early as possible.
