JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 394, 307, 411, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as per F.I.R is that when the informant was counting the money earned through sale of gas cylinder in his office, two persons entered in his office and started firing upon him, one of which hit his right palm and one hit his stomach, as a result of

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not arrested from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has still not been put on T.I.P. It has further been stated that one motorcycle has been recovered from one Manish Kumar Singh, but the same has not been mentioned in the F.I.R. The particulars of the motorcycle has come as improvement of the criminal case by the prosecution. The petitioner is languishing in custody since 25.11.2021.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-IX, Samastipur in connection with Sessions Trial
