====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 25-06-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Kuchaikote P.S. Case No. 404 of 2024 dated 24.09.2024 registered for the offences punishable under Sections 318(4), 333, 336(3), 316(2) read with Section 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the informant and others gave more than Rs. 1,20,000/-to the petitioner and other accused persons who have been running 'Sahara International Training Centre, Baghauch Road, Hans Bhawan, Tyagi Ashram at Sasamusa having Mobile Nos. 906005890 and 9060065722.

2/4 The mobile number of the petitioner is 8287120191. They took money in the name of providing job in Russia and Kuwait and they have sent the informant and others to Delhi and Mumbai showing forged ticket.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is running a Tempo on Road on fare and on the alleged date of occurrence, he had parked his Tempo near 'Sahara International Training and Test Centre, Baghauch Road, Hans Bhawan, Tyagi Aashram, Sasamusa and waiting for passengers, in the meantime, police came with the informant and others and arrested him, Aman Mishra and his staff and took them in the said Institute and thereafter police left Aman Mishra and his staff with connivance with him and arrested the petitioner and sent him to judicial custody. He is neither the owner nor the staff of the said Institute. He has not given forged assurance and letter to the informant and others for sending Russia and Kuwait.

It is further submitted that the mobile numbers given in the F.I.R. does not belong to the petitioner. The informant and others have not given money in the account of the petitioner by Payphone or deposited in his account.

3/4 course of investigation, police seized 73 passports of different persons from the said Institute but no incriminating article has been recovered from the possession of the petitioner. The petitioner is only the earning member of his family by running Tempo on fare and that is his livelihood. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 24.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Kuchaikote P.S. Case No. 404 of 2024 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
