The petitioner apprehends his arrest in a case registered for the offence under Sections 363, 366(A) r/w Section 34 of the Indian Penal Code.
As per the prosecution case, this petitioner alongwith co-accused Rahul Kumar kidnapped the minor daughter of the informant for the purpose of marriage.
It is submitted on behalf of petitioner that as a matter of fact, there was love affairs between co-accused Rahul Kumar and daughter of the informant and there is no allegation of any overt act against this petitioner. Petitioner has been falsely implicated in this case only because he is brother of co-accused Rahul Kumar.
However, learned A.P.P. for the State opposed the bail
Patna High Court CR. MISC. No.11440 of 2022(2) dt.11-08-2022 2/2 petition and submitted that the victim girl, in her statement recorded under Section 164 Cr.P.C., has supported the prosecution case and learned court below has assessed her age, as16 years.
Considering the same, the prayer for anticipatory bail of petitioner is rejected.
