The petitioner seeks bail in connection with K.Hat (Maranga) P.S. Case No.404 of 2023 registered for the offence under Section 302 and 201/34 of the Indian Penal Code.

3. As per the prosecution case, all the accused persons committed the murder of the son of the informant and the reasons behind this occurrence is said to be longstanding land dispute.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case and the informant and the accused persons are own agnates and several civil and criminal dispute are going on in between them. He next submits that similarly situated co-accused persons have already been granted bail by different coordinate

Patna High Court CR. MISC. No.13256 of 2024(2) dt.11-03-2024 2/2 Benches of this Court passed in Cr. Misc. Nos. 61613 of 2023, 60109 of 2023 and 60256 of 2023.

Learned APP appearing for the State as well as the Informant opposes the prayer for bail of the petitioner. Learned counsel for the informant submits that the petitioner is kingpin of the coordinated crime committed by him and other co-accused persons.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with K.Hat (Maranga) P.S. Case No.404 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea with following condition:-

Accused/Petitioner shall cooperate in the trial and shall be physically present on each and every date before the Trial Court till conclusion of the trial and exemption from physical appearance be allowed by the Trial Court, only on medical ground of the petitioner duly supported by documents.
