Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 420, 406, 504, 504, 506/34 of the Indian Penal Code and 3(1) (ii) of the S.C./S.T.(Prevention of Atrocities) Act The prosecution case is that co-accused Aman Jaipuriya @ Aman Singh and this petitioner meet the informant, when Aman Jaipuriya @ Aman Singh conveyed to the informant that he has proposed to open a school and register the Scheduled Tribe people under the Birsa Munda fund. Aman Jaipuriya @ Aman Singh further offered the informant to made him Chairman of the said school and demanded Rs. 3,00,000/- when Rs. 2,80,000/- was paid by
Patna High Court Cr.Misc. No.6714 of 2016 (2) dt.15-02-2016 the informant by several installment, but neither the school or hostel were opened nor the money was returned and when protest was made the accused persons including the petitioners abused the informant by calling caste name. It is submitted by the learned counsel for the petitioner that offers made four years prior to the occurrence. The First Information Report has been lodged and subsequently the informant has retracted from the initial version and filed a petition to that effect before learned court below. Considering the delayed nature of accusation, it is a case for consideration for prayer for regular bail let, the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with S.C./S.T. Araria P.S. Case No. 09 of 2014, pending in the court of learned Chief Judicial Magistrate, Araria. With the above observation this application is disposed of.
It is expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same day.
