JUSTICE ARUN KUMAR ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

Petitioner is an accused in a case registered for offence punishable under Section 392 of the Indian Penal Code. Allegation is of robbery in the evening hours. FIR is against unknown and the petitioner's name transpired during investigation and revealed in confessional statement of the coaccused and he also confessed his involvement before the police. Submission is that there is no recovery of any looted articles from the possession of the petitioner. Moreover, the petitioner was also not put on Test Identification Parade and the petitioner has no criminal antecedent and has been in custody since 02.10.2016.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.5589 of 2017 (3) dt.23-02-2017 2 / 2 let the petitioner, namely, Pradeep Manjhi be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sherghati, District Gaya, in connection with Sherghati P.S. Case No.349 of 2016, with the condition that the petitioner shall present physically on each and every date before the trial court and in case of failure on two consecutive dates, his bail bond shall be liable to be cancelled.
