====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-03-2019 Heard learned counsel for the petitioner and learned APP representing the State.

Petitioner is seeking anticipatory bail in connection with Laxmipur P.S. Case No. 259 of 2018 registered for the offences punishable under Sections 363, 364, 302 and 201 of the Indian Penal Code.

Learned APP for the State submits that even though, the name of the petitioner has transpired in the F.I.R, it has come in course of investigation. In this connection he has referred to the impugned order of the learned Additional District and Sessions Judge II, Jamui.

In the given facts and circumstances of the case, this Court is not willing to extend the privilege of anticipatory bail to the petitioner. In case the petitioner surrender and pray for

Patna High Court CR. MISC. No.13908 of 2019(3) dt.11-03-2019 2/2 regular bail in the learned Court below, his prayer for bail shall be considered on its own merit and on the basis of the materials available on the record and without being prejudice by the order of this Court.

The application is dismissed.
