The petitioner has prayed for regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.

As per FIR, prosecution case relates snatching of cash of Rs. 3,79,000/- (Three lacs ninety seven thousand) and other articles by the accused persons from the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR rather he has falsely been implicated in this case. Neither the TI Parade has been held till date nor any incriminating article has been recovered from conscious possession of the petitioner. During investigation,

Patna High Court CR. MISC. No.11869 of 2023(2) dt.05-05-2023 2/2 name of the petitioner has came into light on the basis of confessional statement of co-accused namely, Kishan Kumar. Moreover, similarly situated co-accused namely, Roshan Kumar has already been granted bail by this Court vide order 3.4.2022 passed in Cr. Misc. No. 3030 of 2023. The petitioner has got no criminal antecedent and languishing in judicial custody since16.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khagaria (Muffasil) P.S. Case No. 548 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria.
