Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 420, 467, 468, 471, 120B, 323, 379 and 504/34 of the Indian Penal Code.

Allegation against the petitioners is that first of all they sold the land in question to informant's uncle and his son and later on the same land has been sold to another person and in that sale deed petitioner no. 3 was a witness. When protest was made, informant was abused, assaulted and Rs.5000/- was snatched from his pocket.

It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have been falsely implicated in the present case. The matter relates to land dispute. It is a case of civil nature.

On behalf of the State, it is submitted that petitioners are named in the complaint.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.5481 of 2016 (2) dt.18-03-2016 2/2 above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri R. K. Bharati, learned Judicial Magistrate-Ist Class, Motihari, East Champaran, in connection with Complaint Case no. C-1912 of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
