JUSTICE SANJAY PRIYA ORAL ORDER 21-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bhagwanpur P.S. Case 178 of 206, G.R. No. 4591 of 2016 instituted for the offence under Sections 366/34 of the Indian Penal Code. It is alleged in the written report that married daughter of the informant along with her three years old son and niece namely Goldi Kumari were returning from Bhagwanpur market. When they reached near the door of Chotelal Pandey, three persons forcefully kidnapped the daughter of the informant Shashi Kala Devi by a Maruti Car. Out of them, Sonu Singh (petitioner) has been identified by niece of the informant Goldi Kumari. Case diary has been received.

Learned A.P.P. has stated that the victim in her

Patna High Court Cr.Misc. No.12984 of 2017 (3) dt.21-04-2017 2/2 statement under Section 164 Cr. P.C. has fully supported the case and has stated that the petitioner has kidnapped her after giving threat to kill her son and committed illegal act with her. In paragraph-15 of the case diary it has come that the girl has been produced before the court below by the petitioner. In the statement of Goldi Kumari recorded in paragraph-6 of the case diary, she has supported the case and stated that she identified the petitioner as one of the miscreants who had kidnapped his sister along with her three years old daughter.

The victim girl in her statement under Section 164 Cr. P.C. has levelled specific allegation of overt act against the petitioner.

Therefore, this Court is not inclined to grant bail to the petitioner at this stage.

Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial in accordance with law.
