2. The petitioner seeks bail in connection with Nawada Town P.S. Case No. 913 of 2025 dated 26.08.2025 registered for the offence punishable under Sections 126(2), 115(2), 303(2), 109(1), 74, 76, 329(3), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Earlier, vide order dated 03.12.2025 passed in Criminal Miscellaneous No. 77053 of 2025, the petitioner's anticipatory bail application was rejected and anticipatory bail application of co-accused, namely, Vikash Kumar @ Vikash Prasad was allowed vide same order.

4. It is alleged that the all the accused persons including the petitioner came armed with lathi, danda and iron rod and started abusing the informant. When the family members of the informant raised objection, they assaulted her husband, son and daughter-in-law and tried to outrage modesty of the informant. There is specific allegation against the petitioner that he inflicted iron rod blow on the head of the informant with intention to kill her, however, during course of protecting herself, the informant's right hand got fractured.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the matter relates to free fight between both the parties. There is case and counter case between the parties due to land dispute. It is submitted that the petitioner and one Vikash Kumar purchased the land from co-sharer of the informant. The informant has filed Title Suit bearing Title Suit No. 270 of 2025, which is pending before the learned Sub-Judge-Ist, Nawada. It is further submitted that co-accused Vikash Kumar has been granted anticipatory bail vide order dated 03.12.2025 passed

Patna High Court CR. MISC. No.11382 of 2026(2) dt.26-02-2026 3/3 in Criminal Miscellaneous No. 77053 of 2025 by a coordinate Bench of this Court. The petitioner is in custody since 16.12.2025, having two criminal cases against him and charge-sheet has been submitted in the case.

6. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

7. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Nawada Town P.S. Case No. 913 of 2025.
