Petitioners, already in custody, seek bail in Laheri P.S. Case No.299 of 2016 registered under Section 302/34 of the Indian Penal Code.

Allegation in brief is that the informant's brother went away with three accused persons and a day after his dead body was found in a pond.

Learned counsel for the petitioners submits that the petitioners have been made accused but there is no any direct evidence and the postmortem report shows that the deceased died due to drowning and one of the co-accused Md. Imran has been

Patna High Court Cr.Misc. No.11428 of 2017 (3) dt.18-03-2017 2/2 granted bail by a Co-ordinate Bench of this Court by order dated 16.3.2017 passed in Cr. Misc. No.9395 of 2017 and the case of these two petitioners stands on similar footing. The petitioners are in custody since 29.11.2016.

Having considered the said facts and circumstances, the petitioner, namely, Md. Sonu and Md. Bhurara @ Md. Bhura are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A.K. Das, J.M. Bihar Sharif, Nalanda in connection with Laheri P.S. Case No.299 of 2016. (Arun Kumar, J) N.H./- U T
