JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Kalyanpur P.S. Case No. 305 of 2019 for the offenses under Sections 272,273.34 IPC and Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. It is alleged that the name of the petitioner was disclosed by co-accused Kumod Das. Similarly circumstanced other co-accused namely, Md. Rustam and Ajay Ram have been granted anticipatory bail by Coordinate Benches of this Court. Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IX-cum- Special Judge (Excise Act), Motihari, East Champaran in connection with Kalyanpur P.S. Case No. 305 of 2019, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of one month. He is required to report to the Civil Surgeon/ Nodal Officer, Covid19, Motihari, East Champaran, who shall utilize his services appropriately.
