2. The petitioner apprehends his arrest in connection with Thakraha P.S. Case No. 134 of 2025 for the offence registered under sections 316(2), 316(5), 318(4) of the BNS Act.

3. As per the prosecution story, the CDPO, Thakraha, West Champaran alleged that the petitioner who was serving as Executive Assistant has siphoned the amount of the schemes between 10.08.2023 to 07.04.2025 in the ICDS. This led to the FIR.

4. Learned Counsel for the petitioner submits that under erroneous conclusion, the FIR was lodged. In the

No.11648 of 2026(5) dt.08-07-2026 2/3 departmental proceeding, though he lost before the District Magistrate, West Champaran, on appeal, the Divisional Commissioner, Tirhut Division, Muzaffarpur in Service Appeal Case No. 315 of 2025 (Ranu Kumar Dubey vs. State & Anr.) vide an order dated 10.06.2026 has set aside the order of the Collector, West Champaran with a direction for his posting and so far as the salary part is concerned, direction for no work no pay has been issued.

5. The submission is that FIR is there, he shall be fighting the legal battle, has no criminal antecedent, in view of the development that has taken place, he deserves relief.

6. Learned State Counsel submits that this petitioner has criminal antecedent.

7. Considering the submissions of the parties as also the development that has taken place, in that background, this Court is inclined to grant him the anticipatory bail with conditions.

8. Let the petitioner in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class,

(i) one of the bailor should be the family members/relatives of the petitioner, who shall provide official document (Aadhar Card, PAN Card, Driving License, Voter ID) to show his bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of the bail bonds. (Rajiv Roy, J) Vijay Singh/- U T
