JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-12-2022 Though the present writ petition has been filed for directing the Respondent authorities to make payment of ex-gratia assistance amount to the tune of Rs. 1.25 lakhs to the petitioner on account of him being injured in the communal violence, which took place in the year, 1989, however, the Respondent-State has filed a counter affidavit wherein it has been stated that since the petitioner is not a victim of communal riots, as is evident from his statement recorded by the learned Additional District & Sessions Judge III, Bhagalpur

Patna High Court CWJC No.2380 of 2015(2) dt.06-12-2022 2/2 in Sessions Trial No. 908/2008 as P.W.-6, the petitioner is not entitled to any ex-gratia assistance amount and his claim is baseless and false.

In view of the aforesaid, this Court does not find any merit in the present writ petition, hence, the same stands dismissed.
