Having regard to the fact that the petitioner is an employee of Bihar State Food and Civil Supplies corporation (hereinafter referred to as the Corporation) and has grievance that his retirement benefit has not been settled as yet though he had retired way back in the year 2006, all that this Court can say is that if the petitioner has worked till the date of his retirement and was entitled for getting such retirement benefit, the same must be paid to the petitioner within a period of four months from the date of receipt of this order.
Patna High Court CWJC No.2321 of 2015 (2) dt.05-02-2015 Nothing said in this order h however will come on the way of the Managing Director of the Corporation to examine the service history of the petitioner and also find out as to whether the petitioner after being absent in the year 1995 had never reported to the duty in the year 2006. If this aspect of the matter is found to be correct that the petitioner had been absent from duty for a period of 11 years or so, the Managing Director of the Corporation, on representation being filed by the petitioner claiming retirement benefit shall pass necessary order strictly in accordance with law. With the aforementioned observation and direction, this application is disposed of.
