JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in Bhabhu P.S. Case No. 623 of 2016 for the offences punishable under sections 302, 201 and 34 of the Indian Penal Code.

The petitioner is in custody since 28.10.2016. The charge sheet has already been submitted.

In paragraph 3 of the bail petition, the petitioner has mentioned that he has no criminal antecedent. It appears from Annexure-2 that other accused have been granted bail in this case having regard to the facts and circumstances as mentioned above including the fact that coaccused Avinash Pandey was granted bail in Cr. Misc. No. 1412 of 2017, Ajeet Patel @ Ajit Patel was granted bail in Cr. Misc. No.

Patna High Court Cr.Misc. No.20230 of 2017 (2) dt.30-05-2017 2/2 751 of 2017 on 23.2.2017, Arvind Kumar @ Arvind Kumar Singh was granted bail in Cr. Misc. No. 8582 of 2017 vide order dated 27.03.2017 and Neta Patel @ Nitish Patel @ Netash Patel was granted bail in Cr. Misc. No. 10034 of 2017 on the ground of parity, I am inclined to enlarge the petitioner, named above, on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Bhabua P.S. Case No. 623 of 2016 on the condition that the petitioner will extend all cooperation in the trial and will not, in any manner, influence the evidence or the witnesses.
