The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and 47(a) of the Excise Act.
Fifty litres of country made liquor were recovered from the manufacturing place of the petitioners. It is submitted by learned counsel for the petitioners that there is nothing on the record to suggest that the place of seizure belong to the petitioners and the petitioners have only been roped in since earlier also a similar nature of case was
Patna High Court Cr.Misc. No.4854 of 2016 (2) dt.05-02-2016 2/2 registered against the petitioners.
Considering the quantity of recovery, it is a case for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Pakaribarawan P.S. Case No. 223 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Nawada. With the aforesaid observation, this application is disposed of.
