JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 341/323/307/504/34 of the Indian Penal Code.
Allegation of commission of injury at the head is against two persons including the petitioner. The doctor has found single head injury and submission is that it is difficult to attribute as to who has caused single head injury. The occurrence took place due to land dispute. Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.13292 of 2017 (2) dt.22-03-2017 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua/Successor Court, in connection with Ramgarh P.S. Case No.5 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
