2. Pursuant to order dated 02.09.2019, the Engineer in Chief-cum-Special Secretary, Public Health Engineering

Patna High Court MJC No.3743 of 2018 dt.24-09-2019 2/2 Department, Government of Bihar is present in Court and has filed supplementary show cause.

3. From the pleadings and materials on record, the Court finds that the order dated 28.06.2017 passed in CWJC No. 1791 of 2008, has been complied with, though making it subject to the decision in LPA No. 185 of 2018, which cannot be faulted.

4. Accordingly, the application stands disposed off.

5. However, it shall be open to the petitioner to file representation before the competent authority if he finds any error in the calculation made with regard to such payment which, if filed, shall be looked into and appropriate order passed.

6. Personal appearance of the officer stands dispensed with.
