Petitioner seeks bail in Hussainganj P.S. Case No.198 of 2016 instituted under Section(s) 366-A Indian Penal Code pending before the Chief Judicial Magistrate, Siwan. There is allegation in the written report that petitioner kidnapped the minor daughter of the informant. The daughter of the informant gave statement under Section 164 Cr. P.C. on her recovery, which is enclosed as Annexure-2. The victim girl in her statement under Section 164 Cr. P.C. has stated that she was kidnapped by this petitioner and he kept her in a room for 11⁄2 months and forcibly established physical relationship with her. The petitioner used to give her
Patna High Court Cr.Misc. No.11557 of 2017 (2) dt.22-03-2017 2/2 intoxicant due to which she was unable to move. The Court has assessed the age of the victim as 15-16 years. Keeping in view the direct allegation against the petitioner, I am not inclined to grant bail to the Petitioner at this stage.
Prayer for bail is rejected.
However, the petitioner may renew his prayer for bail after nine months if no substantial progress is made in the case.
