JUSTICE BIRENDRA KUMAR ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 411/414/34 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act. Four persons were apprehended on an auto rickshaw from whose possession country-made pistol and cartridges were recovered. The petitioner was an auto driver. Submission is that petitioner had no idea that what the passengers were carrying.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.16330 of 2017 (2) dt.04-04-2017 2/2 amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya/Successor Court, in connection with Sherghati (Dobhi) P.S. Case No.337 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
