====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-07-2026 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 103(2), 61(2) of the Bharatiya Nyaya Sanhita.
3. Prosecution case, in brief, is that on 22.09.2025 at about 3 PM, all the F.I.R. named accused persons, including this petitioner, brutally assaulted the son of informant and coaccused Saif Ali, Mahboob Mian, Ekbal Ali and this petitioner stabbed him in the stomach and back as a result of which, he died on the way to the hospital.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Informant
Patna High Court CR. MISC. No.13231 of 2026(5) dt.23-07-2026 2/3 is not an eye witness to the occurrence and during investigation, one Wasim Ahmad, who was with the deceased at the time of occurrence and claims to be an eye-witness of the incident has stated that it was co-accused Saif Ali who inflicted knife blow on the stomach and back of the deceased and no specific overt act has been alleged against the petitioner by him. Post-mortem report also corroborates the aforesaid allegation as deceased sustained only two incised wounds in the stomach and back. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation, statement of the eye-witness, post-mortem report and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XIV, Gopalganj in connection with Sripur (Shripur) P. S. Case No. 229 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha
