Petitioner is in custody since 30.11.2016 in connection with Bochaha P.S. Case No. 69 of 2016 registered under Sections 395 of Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioners have not been named in the F.I.R. and mere on confessional statement of co-accused, Rajeev Kumar, name of these petitioners have surfaced in this case. Nothing has been recovered from the conscious possession of these petitioners. No T.I.P has been conducted till date. Moreover, co-accused, Rajeev Kumar, on whose confession, these petitioners have been implicated in this case, has already been granted bail vide Cr. Misc. No. 36298 of 2016 by a Bench of the High Court. Considering the nature of accusation, let the petitioner,
Patna High Court Cr.Misc. No.7779 of 2017 (2) dt.21-03-2017 above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-cum- SubJudge,11th, Muzaffarpur in connection with Bochaha P.S. Case No. 69 of 2016.
