An absurd kind of order seems to have been passed by the Members of the District Teachers Employment Appellate Tribunal, Araria in Case No. 63 of 2009. Why the appeal of the present petitioner has been rejected and only case of Parimal Mehta has been taken up and decided is not evident from reading of the order impugned.
In view of the same, the Court is left with no option, but to quash the order, dated 20.11.2014,
Patna High Court CWJC No.2112 of 2015 dt.05-02-2015 2/2 contained in Annexure-10 and remand the matter back to the tribunal for fresh adjudication after giving opportunity of hearing the parties of the dispute including the petitioner.
Writ application is allowed.
