Petitioner seeks bail in a case registered for the offences punishable under Sections 307, 386, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Co-accused Sanjay Yadav had caused firearm injury to the informant, as a result whereof informant died subsequently. There is indirect evidence of involvement of this petitioner in the crime alleged as in the past petitioner has demanded ransom from the informant. Petitioner is in custody since 08.10.2018. Investigation of the case is complete. Learned counsel for the informant opposed the prayer for bail.
Considering the entire facts aforesaid, let the
Patna High Court CR. MISC. No.9936 of 2019(3) dt.02-05-2019 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Daudnagar Police Station Case No. 294 of 2018, with the following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
